After the trial expires: • Core recording and transcription features are restricted • You must activate a paid license to continue using the full App • Trial data (recordings, transcripts) stored locally on your device is not deleted One free trial per user account. Creating multiple accounts to circumvent this limit is prohibited.
5. License Purchase & Payments
WaveLog is sold as a one-time license purchase via Polar (polar.sh), our payment processor and merchant of record. By purchasing a license, you agree to Polar's terms of service. License Purchase • WaveLog licenses are one-time purchases — there are no recurring subscription fees. • Prices are shown in USD and may vary by region. Self-Service Refund (within 14 days, before activation) Within 14 days of purchase, if you have not activated the license key in any WaveLog desktop installation, you can request a full refund directly from your dashboard's Orders section. WaveLog submits the refund to Polar (our payment processor) automatically and the refund is credited back to your original payment method, typically within 5-10 business days. No Refund After Activation Once a license key has been activated in any WaveLog desktop installation, the purchase is final and non-refundable. If you experienced a technical issue that blocked activation, contact diveai.contact@gmail.com within 14 days of purchase and we will investigate. EU/EEA Digital-Content Waiver By activating your license you explicitly acknowledge that the digital content has been delivered and you waive your 14-day right of withdrawal under Directive 2011/83/EU Article 16(m).
6. Acceptable Use
You agree not to use WaveLog to: • Record individuals without their knowledge or consent where required by law • Violate any applicable privacy, wiretapping, or recording consent laws • Infringe third-party intellectual property rights • Circumvent technical protection measures • Attempt to access other users' accounts or data • Use automated scripts to abuse the license validation API You are solely responsible for ensuring your use of WaveLog complies with all applicable laws in your jurisdiction. 8. Disclaimers & Limitation of Liability
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT: • The App will be error-free or uninterrupted • Transcription accuracy will meet any specific standard • The App will be compatible with future versions of macOS TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
9. Termination
We may suspend or terminate your access to the App immediately if: • You breach these Terms • We are required to do so by law • We discontinue the service (with reasonable notice — see Section 10 for the specific commitments that apply in that case) Upon termination, your license to use the App ends. Locally stored recordings and transcripts remain on your device and are not deleted by us.
10. Service Discontinuation
This section supplements Section 9 and sets out the specific commitments that apply if WaveLog as a service is discontinued. Advance Notice • We will provide written notice to all registered users at least 90 days before the discontinuation date, sent to the email address associated with your account and posted on https://wavelog.diveai.io. • New purchases will be disabled immediately upon publication of the discontinuation notice. Continued Use via Offline Build • Before the discontinuation date, we will release a final application update that allows WaveLog to function without our license-validation servers. This offline build preserves the core local features you paid for: recording, transcription, speaker diarization, summaries, jump playback, search, and access to your local data. • Cloud-dependent functionality that cannot be locally replaced (such as automatic update checks and OAuth token renewal for third-party integrations) may cease to function. The discontinuation notice will list these explicitly. Refund Policy • Purchases made after the discontinuation notice is published will be refunded in full automatically within 14 days of payment. • For purchases made before the discontinuation notice, the offline build described above constitutes our fulfilment of the perpetual licence commitment, and no separate refund is provided as a matter of contract — EXCEPT where mandatory consumer-protection law in your jurisdiction requires otherwise (see "Statutory Rights Preserved" below). • A dedicated refund support channel (diveai.contact@gmail.com) will operate for at least 30 days after the discontinuation date to process eligible requests. Statutory Rights Preserved • Nothing in this section limits any non-waivable rights you have under mandatory consumer-protection law in your jurisdiction. Such laws may include, without limitation, EU Directive 2019/770 on contracts for the supply of digital content and digital services, and the Republic of Korea's Content Industry Promotion Act together with the Standard Terms for the Use of Digital Content issued by the Ministry of Culture, Sports and Tourism. • If you reside in the European Union, you may also use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr. • If you reside in the Republic of Korea, you may also seek mediation through the Content Dispute Resolution Committee (콘텐츠분쟁조정위원회): https://www.kcdrc.kr. Your Local Data • Recordings, transcripts, and the local SQLite database stored at ~/Documents/WaveLog/ on your Mac are unaffected by service discontinuation — they remain entirely on your device and under your control.
11. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of the Republic of Korea, without regard to conflict of law principles. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. Unresolved disputes shall be submitted to the exclusive jurisdiction of the courts located in Seoul, Republic of Korea. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
